The agreement between you and us. Written to be read.
Everkept is operated by BE Willers Limited, a company registered in New Zealand, NZBN 9429048630894. Our registered office is recorded on the New Zealand Companies Register and we will give it to you on request. "We" and "us" mean that company. "You" means whoever is using the site.
A place to make a page for an animal who has died — photographs, their story, and the notes people leave. You can make one for free. If we ever charge for it, the price and what it covers are shown before you pay.
You need to be 16 or older to keep an account, and to give us an email address that reaches you. Keep your password to yourself; anything done from your account is treated as done by you.
What you upload stays yours. We do not claim ownership of your photographs or your writing. You give us permission to store them and to show them to the people you have chosen to show them to — that is all, and only so the service can work.
By putting something here you are telling us that:
We may remove content or close an account if it is unlawful, if it impersonates somebody, if it is there to abuse or deceive, or if someone tells us it was taken and published without their permission. Where we can, we will tell you first and give you the chance to download your copy.
We will do our honest best to keep your pages available and your photographs safe, and to give you plenty of notice if any of that has to change. We cannot promise the site will never be down, and we are not able to promise it will exist forever — no one honestly can.
What we do promise is that you will never be locked in. You can download everything you keep here at any time from your account, and if we ever had to close the service we would tell you well in advance and make sure you could take your pages with you. Keep your own copies of anything that matters. We would say that even if we were certain of our own future.
To the extent the law allows, the service is provided as it is, and our liability to you is limited to whatever you have paid us in the twelve months before the problem — which for most people is nothing. Nothing here limits rights you have under the New Zealand Consumer Guarantees Act or Fair Trading Act, or equivalent consumer law where you live.
If you buy anything, payment is handled by Paddle.com Market Ltd, who act as merchant of record and are the seller on your receipt. Their terms cover the transaction; ours cover the service. Our refund policy says what happens if you change your mind — the short version is that you get your money back.
Making a new page needs a current plan. The price is shown before you write anything, never partway through.
Not paying never deletes anything. If a payment fails or a subscription ends, every page you have already made stays up, stays reachable at the same address, and stays yours to change. Only making a new one needs you to start paying again.
You can delete a memorial, or close your account entirely, from your account, at any time. Deleting is permanent and removes the photographs too, so download your copy first if you want one.
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If you are a consumer somewhere else, this does not take away protections you have at home.
If we change these terms we will update this page and the date at the top. If a change genuinely matters to you, we will email you about it rather than hoping you notice.
